Chapter 25

א אבל מהנה שרי ורבי יוחנן אמר אפילו מעוטרות בפירות נמי אסור ק"ו נהנה אסור מהנה לא כ"ש
1 all the more so it is prohibited to provide benefit. But R. Yohanan said: Even if they are decorated with other types of produce they are also forbidden. For this is an a fortiori argument. If deriving benefit is prohibited, all the more so it is prohibited to provide benefit.
ב מיתיבי רבי נתן אומר יום שעבודת כוכבים מנחת בו את המכס מכריזין ואומרים כל מי שנוטל עטרה ויניח בראשו ובראש חמורו לכבוד עבודת כוכבים יניח לו את המכס ואם לאו אל יניח לו את המכס
2 They raised a difficulty: R. Natan says: On the day when the idolaters reduce the taxes, they proclaim: “Whoever takes a wreath and puts it on his head and on the head of his donkey in honor of the idols, his tax will be remitted; otherwise his tax will not be remitted!” A Jew who is found there, what should he do?
ג יהודי שנמצא שם מה יעשה יניח נמצא נהנה לא יניח נמצא מהנה
3 If he puts it on, it turns out that he is benefiting! If he does not put it on? Then he is providing benefit!
ד מכאן אמרו הנושא ונותן בשוק של עבודת כוכבים בהמה תיעקר פירות כסות וכלים ירקבו מעות וכלי מתכות יוליכם לים המלח ואיזהו עיקור המנשר פרסותיה מן הארכובה ולמטה
4 From here they said: One who engages in business in a market of idolaters, if it be cattle it should be disabled, if fruit, clothes or utensils, they should be allowed to rot, if money or metal vessels he should carry them to the Dead Sea. What is meant by disabling? Cutting the tendons of the hoofs beneath the ankle.
ה קתני מיהת יניח נמצא נהנה לא יניח נמצא מהנה
5 In any case we are taught, “If he puts it on, it turns out that he is benefiting! If he does not put it on? Then he is providing benefit!”
ו אמר רב משרשיא בריה דרב אידי קסבר רשב"ל פליגי רבנן עליה דרבי נתן ואנא דאמרי כרבנן דפליגי עליה ור' יוחנן סבר לא פליגי
6 Mesharsheya the son of R. Idi said: R. Shimon b. Lakish holds that the rabbis disagree with R. Nathan, and I (Resh Lakish) say like the Rabbis who disagree; whereas R. Yohanan holds that they do not disagree.
ז ולא פליגי והא תניא הולכין ליריד של עובדי כוכבים ולוקחין מהם בהמה עבדים ושפחות בתים ושדות וכרמים וכותב ומעלה בערכאות שלהן מפני שהוא כמציל מידם
7 But do the rabbis not disagree? Was it not taught: One may attend a fair of idolaters and buy from them cattle, slaves, maidservants, houses, fields and vineyards; one may even write the necessary documents and bring them to their courts because this is like rescuing from their hands.
ח ואם היה כהן מטמא בחוצה לארץ לדון ולערער עמהם וכשם שמטמא בחוצה לארץ כך מטמא בבית הקברות
8 If he is a priest he may be defiled by going outside the Land for the purpose of arguing the matter with them and have it tried in court. And just as he may defile himself [by going] outside the Land, so he may become defiled by walking on a burial ground.
ט בבית הקברות סלקא דעתך טומאה דאורייתא היא אלא בית הפרס דרבנן
9 “A burial ground”! Do you really think that? This is biblical defilement! Rather a field that is a doubtful burial ground.
י ומטמא ללמוד תורה ולישא אשה א"ר יהודה אימתי בזמן שאין מוצא ללמוד אבל בזמן שמוצא ללמוד אינו מטמא
10 And one may be defiled for the sake of studying Torah or marrying a woman. Judah said: This only applies when he cannot find [a place elsewhere] to learn, but when he can find elsewhere to learn he may not be defiled;
יא רבי יוסי אומר אפילו בזמן שמוצא ללמוד יטמא לפי שאין אדם זוכה ללמוד מכל
11 But R. Yose said: Even when he can find elsewhere to learn he may defile himself, for a person may not be able to learn from everyone.
יב א"ר יוסי מעשה ביוסף הכהן שהלך אחר רבו לצידן ללמוד תורה ואמר רבי יוחנן הלכה כרבי יוסי
12 Yose said: It happened that Joseph the Priest went after his master to Zidon. And R. Yohanan said: The halakhah is according to R. Jose.
יג אלמא פליגי אמר לך רבי יוחנן לעולם לא פליגי
13 Hence the Sages do disagree! Yohanan could answer you: The rabbis indeed do not disagree [with R. Natan], yet there is no difficulty here:
יד ולא קשיא כאן בלוקח מן התגר דשקלי מיכסא מיניה כאן בלוקח מבעל הבית דלא שקלי מיכסא מיניה
14 The one case refers to purchasing from a dealer, from whom the tax is exacted, the other case refers to purchasing from a private individual from whom the tax is not exacted.
טו אמר מר בהמה תיעקר והא איכא צער בעלי חיים אמר אביי אמר רחמנא (יהושע יא, ו) את סוסיהם תעקר
15 The master stated: “Cattle should be hamstrung.” But is there not the prohibition of causing suffering to a living being? Abaye said: The Torah says, “Their horses you shall hamstring” (Joshua 11:6).
טז אמר מר ואיזוהי עיקור מנשר פרסותיה מן הארכובה ולמטה ורמינהי אין מקדישין ואין מחרימין ואין מעריכין בזה"ז ואם הקדיש והחרים והעריך בהמה תיעקר פירות כסות וכלים
16 The Master said: “What is meant by disabling [cattle]? The cutting of the tendons beneath the ankle.” The following is cited as contradicting it: One should not sanctify, or devote, or evaluate at the present time; and if one did sanctify, devote or evaluate, then if it be cattle it should be disabled, if fruit, clothes or utensils
